LEGAL PROTECTION OF PROTECTED DESIGNATION OF ORIGIN AT THE TIME OF THE THE PANDEMIC

Abstract

Protected designation of origin is related to the quality of goods originating from a certain geographical area. Therefore, third parties believe that these are goods that have special properties, while the subjects of protection provide protection on the basis of the established specificity of the product, which although it could be produced anywhere in the world, if produced in a given locality, is a unique product as such it is possible to produce only in a given geographical area. Geographical space is not a strictly defined term, so it couldbe a certain country, region, local community, city and village. If a person who has marked his goods with a mark of origin, and does not produce the same goods in accordance with the obtained mark, shall be considered to be committing a criminal offense of economic crime. Conversely, a person engaged in the production of the same type of goods, but who does not possess a Protected designation of origin, if he puts a PDO or a similar indication on his product, seriously infringes the subjective rights, and thus commits unfair competition. The establishment of Protected designation of origin is not negligible for economic entities, it has multiple significance for the economy of countries, therefore disputes that violate the Protected designation of origin, given their economic value, are not negligible.
